What VAT rules apply when you sell cross-border in the EU?

VAT on most online sales to EU consumers is due in the customer's country. Since 1 July 2021, an EU-wide threshold and the One Stop Shop (OSS) have made this easier to manage.

  • €10,000 threshold: a business established in one EU country can charge its home VAT while its cross-border B2C sales stay at or below €10,000 a year. Above that, the customer's country's VAT applies.
  • Union OSS: instead of registering in every country, you register in one Member State and file one quarterly OSS return for your EU distance sales.
  • Import OSS (IOSS): for goods imported in consignments worth up to €150, you can charge VAT at checkout and file one monthly return.
  • Marketplaces: when a non-EU seller sells goods to EU consumers through an online marketplace, the marketplace is treated as the supplier for VAT.

What should you check before expanding into a new EU market?

Start with where your goods are stored and who your customers are. These two facts decide whether OSS is enough or whether you need a local VAT number.

OSS covers distance sales between EU countries. Goods already stored in the customer's country are sold as domestic supplies, which you normally report on a local VAT return.

  1. Total your cross-border B2C sales and compare them with the €10,000 threshold.
  2. Map where your stock is held, including marketplace fulfilment centres.
  3. Decide whether to register for OSS in your home Member State.
  4. Check the VAT rates for your products in each target country.

Our guide on how to register for VAT in the EU walks through each step.

When are OSS returns due?

An OSS return is due by the end of the month after each period. The period is a calendar quarter for the Union and non-Union schemes, and a calendar month for the import scheme (IOSS).

The EU OSS portal sets out the main rules:

  • Example: sales made from January to March must be declared by 30 April.
  • Payment: pay with the return, and at the latest by the same end-of-month deadline.
  • Weekends: the deadline does not move if it falls on a weekend.
  • Nil returns: if you made no sales under the scheme in a period, you still submit a nil return.
  • Corrections: you can correct an earlier return within three years of its original due date.
  • Currency: returns are generally made in euro, although some non-euro Member States may require their national currency.

So come along and let’s make 2024 a successful year!  We look forward to seeing you in Berlin!
